Vibotype Terms of Service

Vibotype is a short quiz about how your desire works, with an optional deeper written reading. It is operated by Our Senses ("we", "us"), the company name you will see on your card statement. Using vibotype.com (the "Service") means you agree to these Terms. If you do not agree, do not use the Service.
We have tried to write these Terms the way we write everything else here: plainly. The section headings are honest summaries, not decoration.
1. You must be 18 or older
Vibotype asks about your sex life as it actually is, so this room is adults only. When you start the quiz you attest that you are 18 or older. Right now that attestation is your word; before wide public launch we will add third-party age verification.
If a minor has used the Service on your device or account, stop using it and write to us at the address in Section 12.
2. This is self-reflection, not medicine
The Service exists for self-reflection. It does not provide medical advice, and it does not diagnose, treat, or cure any condition. Nothing you read here replaces a doctor, a therapist, or any other qualified professional. If something in your sex life worries you, take it to a professional, not a quiz.

3. What the words here are
Everything you read in your result and in the After Party reading is editorial: written, argued over, and published by us. It describes patterns, not facts about your body or your relationship. Some of it will fit you; some of it will not. You are the judge of which is which.
4. Your answers are sensitive, and treated that way
Your quiz answers concern sexual behavior, which the EU General Data
Protection Regulation calls "special-category data" under Article 9. We
process those answers only with your explicit consent, which you give on
the consent screen before the quiz, separately from these Terms. You can
withdraw consent and delete your data at any time; the Privacy Policy at
/legal/privacy explains exactly how, and /legal/companion-processing
lists every third party that touches the data.
5. Purchases and refunds
Paid features (such as the After Party and the Couples Map) are one-time purchases, priced in plain sight, processed by Stripe. We never see your full card number.
Refunds are simple: if a purchase did not land for you, ask within 30 days and we will put the money back. There is a self-serve refund door on every paid surface. We may decline a request that is obviously gaming that promise (the same card cycling refunds across accounts, say), but the benefit of the doubt is yours.
6. House rules
Do not use the Service to harass, threaten, or harm anyone. Do not try to get at another person's account or answers. Do not probe or attack our infrastructure outside a responsible disclosure. Do not hammer the Service with automated traffic. We may suspend or close accounts that break these rules.
7. Leaving
You can delete your data at any time from your result page or
/account/privacy. We may suspend or terminate accounts that materially
breach these Terms; where we reasonably can, we will tell you first.
Sections that by their nature outlive termination (intellectual property,
disclaimers, limits of liability, indemnification, governing law) do.
8. Limits of liability
To the maximum extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim will not exceed the greater of (a) what you paid us in the 12 months before the claim or (b) US$100.
9. Indemnification
If your breach of these Terms or misuse of the Service gets us sued, you agree to cover the claim, the losses, and reasonable attorneys' fees.
10. Where disputes go
The Service is operated from the United States. These Terms are governed by Delaware law, without regard to its conflict-of-laws rules. Before anyone files anything, you agree to write to us first and give us 30 days to fix the problem informally. If that fails, disputes go exclusively to the state or federal courts in Delaware, and both sides consent to their jurisdiction.
11. Changes
We may update these Terms. Material changes get announced on the Service
and, where reasonable, by email if we have one for you. The live version
is always the one at /legal/terms.
